Ordinance
Notice is hereby given by the Letcher County Fiscal Court that it intends to enforce Letcher County Ordinance No. 90-03, which was enacted by the Letcher County Fiscal Court and went into effect on September 1, 1990. This Ordinance requires all households in Letcher County to participate and sign up with the local garbage collection program.
This Ordinance is mandatory in nature and requires that all households subscribe to the garbage pickup service in their magisterial district.
Failure to subscribe to this mandatory garbage service is a criminal violation, which subjects violators to a fine of not less than $25.00, or more than $500.00 for each day of said violation.

CITIZENS PARTICIPATION PLAN FOR COMMUNITY DEVELOPMENT BLOCK
GRANT- DISASTER RECOVERY
The Letcher County Fiscal Court utilizes a citizen's participation plan to set forth the
policies and procedures that will be used to solicit citizen's input for the Community
Development Block Grant-Disaster Recovery process. The policies are designed to
encourage participation by low- and moderate-income persons, particularly those living
in slums and blighted areas and in areas where CDBG-DR funds are proposed to be used
and by residents of predominantly low- and moderate-income neighborhoods. The
Letcher County Fiscal Court will also encourage the participation of all county citizens,
including minorities and non-English speaking persons, as well as persons with
disabilities, and will provide accommodations as needed.
Public Hearings to Develop the Application
Prior to the development of the application the Letcher County Fiscal Court will hold a
public hearing to obtain views of citizens, public agencies, and other interested parties on
community and housing needs. The hearing will be widely publicized through the use of
newspaper advertising. The purpose of this hearing is to obtain views on housing and
community development needs, review proposed activities, review the proposed
application(s), and solicit public comments. Technical assistance is available to help
groups representing low- and moderate- income persons in developing proposals.
Prior to the hearing, the County will make the following information concerning the CDBG-
DR programs available for public inspection at the Letcher County Fiscal Court Office
during regular business hours:
A. Amount of funds available and range of activities that may be undertaken.
B. Estimated amounts of funds proposed to be used for activities benefiting persons
of low and moderate income.
C. Plans for minimizing displacement of persons as a result of activities associated
with CDBG-DR funds and plans for aiding those persons to be actually displaced
as a result of CDBG-funded activities.
D. Records regarding the past use of CDBG funds.
E. A summary of other important program requirements.
Amendments to the Application
In the event of a substantial change to the proposed activities in an application to the
Commonwealth and, for grants that are already made, activities which are proposed to
be added, deleted or substantially changed from the County’s application to the
Commonwealth, the County will provide citizens with reasonable notice and the
opportunity to comment on any proposed amendment. Notification will be made through
publication in major newspaper(s) throughout the County. Citizens will have fifteen (15)

days after the proposed amendment is published to submit written comments on the
proposed amendment. The County will review and take into consideration any comments
or views submitted in the preparation of an amendment to the proposed activities. A
summary of the comments or views will be attached to the amendment to the plan as well
as reasons for not accepting any comments. Substantially changed means changes
made in terms of purpose, scope, location or beneficiaries as defined by criteria
established by the Commonwealth.
Public Hearing for Review of Program Performance
Prior to project closeout, the County will hold a public hearing to advise citizens of
progress made during the grant and pending closeout of the project. The hearing will be
advertised at least 7 days prior in the newspaper of largest circulation. Written comments
will be received until the date of the hearing (at least 7 days form publication). All
comments will be considered or, if applicable, the County will provide reasons for rejection
of comments. All comments and responses will be filed in citizen participation and
closeout files.
Complaints and Grievances
For complaints and Grievances from citizens related to the Project or the Performance
Report, the County will address written complaints within fifteen (15) working days where
practicable.

Four-Factor Analysis
The following four-factor analysis will serve as the guide for determining which language
assistance measures the County will undertake to guarantee access to DLG’s federally
funded programs by LEP persons. The Department for Local Government (DLG)
requires grantees to use the following four-factor analysis for CDBG-DR Programs prior
to the release of funds.
1. The number or portion of LEP persons eligible to be served or likely encountered
through its federally funded programs.

• For determining the LEP population, Letcher County utilized the U.S.
Census Bureau’s American Community Survey Language Use data for
Language Spoken at Home and English-Speaking Ability by County in
Kentucky
2. The frequency with which LEP individuals come in contact with the designated
federal programs.
• The number of LEP persons in the County is limited, therefore the County
does not frequently come into contact with LEP individuals.
3. The nature and importance of the program, activity or service provided by the
federal programs.
• The County is a recipient of federal grants to increase affordable housing
for disaster recovery.
4. The resources available to the recipient and the cost. There are two types of
assistance service – oral (interpretation) and written (translation).
• Due to the small percentage and number of LEP persons in the County,
Letcher County will adhere to the following DLG LAP requirement:
i. The DLG Language Access Plan specifies for recipients of federal
funds, that “if the four-factor analysis reveals there are less than 50
LEP persons and less than 5 percent LEP persons in the eligible
population in the jurisdiction or among current beneficiaries, the
applicant will provide appropriate language assistance by providing
translation services at public hearings, if requested to do so by LEP
persons.”
